THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9888 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C") seeking regular bail to the petitioners who are arrayed as Accused Nos.2, 3, 5 and 6 in Crime No.219 of 2022 pending on the file of Station House Officer, Ibrahimpatnam Police Station, Jagtial District registered for the offences punishable under Sections 143, 452, 307, 324, 354, 290, 323 and 506(ii) read with Section 149 of Indian Penal Code (IPC) and Section 3(1)(r)(s), 3 (2)(v) of SC/ST POA Act. 2.

Heard learned counsel for the petitioners-Accused Nos.2, 3, 5 and 6 and learned Additional Public Prosecutor for the respondentState. Perused the record. 3.

Briefly the facts of the case are that on 05.10.2022 the de facto complainant and others celebrated the dussera festival. On which date, the accused abused the de facto complainant and others with an intention to kill them. These petitioners were also part of ten members who attacked the de facto complainant and her family members.

Learned Additional Public Prosecutor submits that in the incident nearly six persons received injuries however, they were treated as outpatients.

As seen from the remand report, it appears to be a group fight in between the complainant party and the accused. The remand report and the complaint reveal that all these petitioners were part of the group which attacked the de facto complainant's family however, nothing is specifically stated against these petitioners.

In the said circumstances, since the petitioners are aged around 20 years and they are in custody since 10.10.2022, they can be granted the relief of regular bail.

Accordingly, the Criminal Petition is allowed and the petitioners-Accused Nos.2, 3, 5 and 6 are granted bail subject to the following conditions:

i) The petitioners-Accused Nos.2, 3, 5 and 6 is directed to be released on bail on their executing personal bonds for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties for

a like sum each, to the satisfaction of III Additional Sessions Judge at Karimnagar.

ii) After release on bail, the petitioners-Accused Nos.2, 3, 5 and 6 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks and thereafter as and when required for the purpose of investigation.

iii) The petitioners-Accused Nos.2, 3, 5 and 6 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 16.11.2022 ns
