THE HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No. 1088 OF 2013 ORDER:

This Writ Petition is filed to declare order dated 14-12-2012 of respondent No. 3 in Appeal No. 5/2012 filed against order dated 04-03-2011 of respondent No. 2 as illegal and arbitrary and consequently to declare that the petitioner is landless poor person and entitled for renewal of lease.

The case of the petitioner is that the Regional Joint Commissioner, Endowments Department, Multi Zone - II, Tirupati, Andhra Pradesh-respondent No. 3 by order dated 14-12-2012 confirmed the orders of the Assistant Commissioner of Endowments, Chittoor District-respondent No. 2 dated 04-03-2011 rejecting the claim of the petitioner to declare that he is landless poor person and entitled for renewal of lease in respect of land measuring Ac. 16.17 cents in survey Nos. 19 to 22 of Pytipalli Village, Tirupati Rural Mandal, Chittoor District. 3.

Today when the matter came up for hearing, learned Government Pleader for Endowments submits that as per the amended rules framed under G.O.Ms.No. 419 dated 09-11-2015, Assistant Commissioner has been conferred power to inquire about the status of landless poor persons every three years and that in similar facts and circumstances, this Court disposed of W.P.No. 14787 of 2008 by order dated 21-04-2017 permitting the petitioner therein to make an application under G.O.Ms.No. 419

dated 09-11-2015 to the Assistant Commissioner of Endowments.

In the light of the changed circumstances, this Writ Petition is disposed of directing the petitioner herein to make an application under G.O.Ms.No. 419 dated 09-11-2015 if he is so advised. Pending miscellaneous petitions, if any, shall stand closed in consequence. No costs.
