THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5383 of 2016 ORDER:

This petition is filed by A.1 to A.5 under Section 482 of Cr.P.C. seeking to quash the proceedings in C.C. No.732 of 2014 pending on the file of XIII Metropolitan Magistrate, R.R.District, L.B.Nagar for the offence under Section 498-A IPC and Sections 3 & 4 of Dowry Prohibition Act. When the matter is taken up for hearing, the de facto complainant, who is the wife of A.1 filed an affidavit stating that due to the intervention of elders, she settled the dispute with the accused and therefore, she is not interested to prosecute the impugned proceedings. The parties who are present in the Court also affirmed the same.

In view of the amicable settlement of the dispute between the parties and in view of the nature of the proceedings, no purpose would be served in keeping the impugned proceedings pending. Hence, the Criminal Petition is allowed and the proceedings in C.C. No.732 of 2014 pending on the file of XIII Metropolitan Magistrate, R.R.District at L.B.Nagar are hereby quashed as against the petitioners herein. It is directed that the affidavit shall form part of the record.
