THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.9198 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"issue Writ Order or Direction more particularly one in the nature of Writ of Mandamus by declaring the action of the Respondents in not regularizing the services of the petitioners in any existing aided suitable post as per their seniority and eligibility as done in the case of similarly situated persons vide GORt.269, HE, dt.13.11.2014 is illegal, and further direct the respondents to regularize the services of the petitioners in the existing aided vacancies under the 3rd respondent as per the seniority and eligibility."

2. Heard Sri P.Raghavender Reddy, learned counsel, appearing for the petitioner and learned Government Pleader for Higher Education, appearing for the respondents.

3. Petitioners are working as Record Assistants and Attenders in the 3rd respondent Institution. It is submitted that on the request made by the petitioners, the 3rd respondent herein submitted proposals to the 2nd respondent - Commissioner of Collegiate Education, for consideration of the case of the petitioners for regularization of their services and a copy of the said proposal bearing Ref.No.SNVMV/557/2015-16, dated 18.12.2015 is placed on record.

During the course of hearing, it is submitted by the learned counsel for the petitioner herein that services of the similarly situated persons are regularized vide G.O.Rt.No.269, Higher Education (CE/A2) Department, dated 13.11.2014. It is further requested that the respondents 1 and 2 may be directed to pass appropriate orders on the

proposals submitted by the 3rd respondent herein, in accordance with law, by fixing some timeframe. This Court considers the said request as reasonable.

For the aforesaid reasons, Writ Petition is disposed of, directing the respondents 1 and 2 to take appropriate action on the proposals submitted by the 3rd respondent herein vide Ref.No.SNVMV/557/201516, dated 18.12.2015 and pass appropriate orders, in accordance with law, within a period of three months from the date of receipt of a copy of this order.

6. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 21.03.2016 SS
