THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.12846 OF 2017 DATED : 13.04.2017 Between :

V.Rajyalaxmi W/o.Late V.Narasimha Rao, Age : 77 yrs, R/o.H.No.10-2-38, Mamillagudem, Khammam City and District, Telangana State.

..

Petitioner And The State of Telangana, Rep., by its Principal Secretary, Education Department, Hyderabad & others.

.. Respondents This court made the following :

- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.12846 OF 2017 ORDER :

Heard.

2.

Petitioner is challenging the order dated 10.03.2017, whereunder an amount of Rs.1,80,000/- sought to be recovered in 10 monthly instalments. The said order was passed on the allegation that false medical reimbursement claim was made by the petitioner and on verification it was found as a false claim and therefore, recovery was ordered. In the representation submitted by the petitioner on 16.05.2015, she requested for reducing the amount of recovery @ Rs.2000/- per month.

3.

Petitioner does not dispute that huge amount of medical reimbursement was claimed, though she was not entitled. Thus, I do not see any error in the order of recovery. 4.

Learned counsel for the petitioner submits that the amount of recovery @ Rs.18,000/- per month is huge and because of the ailments with which petitioner is suffering, and on account of her advanced age, petitioner is unable to make such a payment and atleast if the amount is reduced it would suffice her interest. 5.

Having regard to the submissions of learned counsel for the petitioner, the representation dated 16.05.2015 and age of the petitioner, I deem it proper to modify the recovery schedule and respondents are directed to recover the amount @ Rs.5000/- per month instead of Rs.18,000/-.

6.

With the above directions, the writ petition is disposed of. There shall be no order as to costs.

- 3 - Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
