ORDER:

Heard.

2. Petitioner, who is stated to be a senior citizen claims that on account of the matrimonial dispute between one of his sons and respondent No.3, crime No.396 of 2014 is registered with respondent No.2 and as such, petitioner and his family members are being harassed on account of the registration for the said crime.

Respondent No.3 had already approached this court in W.P.No.40064 of 2014 alleging inaction of the respondent in investigating the said crime and the said writ petition is pending.

3. Learned Government Pleader, on instructions, submits that the petitioner and his entire family is stated to be absconding, hence, the question of calling and harassing the petitioner and his family members is denied.

4. In view of the registration of the crime and the requirement of respondent No.2 to investigate the same, the respondent No.2 is at liberty to investigate the said crime expeditiously. However, so far as the petitioner is concerned, since he being a senior citizen, aged 60 years, due regard to that shall be maintained by respondent No.2.

The petitioner shall not be unnecessarily called to the police station unless his presence is absolutely essential.

Writ petition is, accordingly, disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
