THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI AND THE HON'BLE SRI JUSTICE NAMAVARAPU RAJESHWAR RAO Writ Petition No.41013 of 2022 ORDER : (Per Hon'ble Justice Abhinand Kumar Shavili) This Writ Petition is filed by the petitioners under Article 226 of the Constitution of India seeking a Writ of Mandamus to declare the action of 2nd respondent in not considering the representations submitted by the petitioners including the representation dated 03.11.2022 for accepting delayed application for admission into MBBS/BDS courses for the academic year 2022-2023 under the management quota pursuant to notification dated 19.10.2022 as arbitrary, unreasonable; and for a consequential direction to the 2nd Respondent to permit the 1st petitioner to submit application for admission into MBBS/BDS courses for the academic year 2022-2023 under the management quota i.e., B-category, C-category in private un-aided non-minority/minority medical/ dental colleges affiliated to the 2nd respondent by considering the representation dated 03.11.2022.

Learned counsel for the petitioners contended that 1st petitioner has appeared for National Eligibility-cumEntrance Examination, 2022 (N.E.E.T.) and secured a decent rank in the said examination; 1st petitioner has responded to the admission notification issued by the 2nd respondent-University in the 'Convenor Quota'; however, the 1st petitioner could not respond to the notification issued by the 2nd respondent-University on 19.10.2022 for the 'Management Quota' owing to various difficulties; thereafter, the father of 1st petitioner (2nd petitioner herein) submitted a representation to the 2nd respondentUniversity on 03.11.

2022, requesting the 2nd respondentUniversity to permit the 1st petitioner herein to participate in the admission process under 'Management' category of seats; but, so far the 2nd respondent-University has not passed any order on the said representation; and therefore, prayed this Court to pass appropriate orders in the Writ Petition by directing the 2nd respondent-University to consider the representation submitted by the 2nd petitioner dated 03.11.2022 and pass appropriate orders in accordance with law.

On the other hand, learned Standing Counsel for the 2nd respondent-University submitted that since 2nd petitioner's representation is pending with the 2nd respondent-University, the 2nd respondent-University would consider the same and pass appropriate orders in accordance with law.

This Court, having considered the submissions made by the parties, is of the considered view that the present Writ Petition can be disposed of by directing the 2nd respondent-University to consider the representation submitted by the 2nd petitioner dated 03.11.2022 and pass appropriate orders in accordance with law within a reasonable period of time.

With these observations, the Writ Petition is disposed of. No costs.
