notice bearing No.345/344/1/5/TPS/C-14/GHMC/2018 dated 10.8.2018 issued by the Respondent Corporation under the provisions of Section 452(1) and 461(1) of GHMC Act, 1955 is under challenge in the present writ petition.

In the said show cause notice, the Respondent Corporation pointed out certain deviations. In response to the said show cause notice, according to the petitioners, they have submitted explanation by way of legal notice dated 13.8.2018. It is submitted by the learned counsel for the petitioners that despite pendency of the said explanation in the form of legal notice filed in response to the said show cause notice, the Respondent authorities are interfering with the construction activities of the petitioners. On the other hand, it is submitted by the learned Standing Counsel for Respondent Corporation that the legal notice was sent on 13.8.2018 and this writ petition came to be filed on 16.8.2018 without waiting for the response. 3.
Having heard the learned counsel for the petitioners and the learned Standing Counsel appearing for the Respondent Corporation, this Court deems it appropriate to dispose of the writ petition with a direction to the Respondent Corporation to consider the explanation/legal notice dated 13.8.2018 (received by the Respondent Corporation on 14.8.2018) and pass appropriate orders and proceed further strictly in accordance with law. 4.
Accordingly, the writ petition is disposed of. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
