THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.17821 OF 2017 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue an order or direction, more particularly in the nature of Writ of Mandamus by declaring impugned action of the 2nd respondent vide proceedings No.37/TP/PER/HO/TPS/GHMC/CT/2016/1754, dated 22.12.2016 in granting permission to the 3rd respondent for erection of telecommunication infracture Towers (TIT) (Root Top Tower) (RTT) and ground based tower (GBT) in respect of flats situated at by name Viraj Towers in Survey No.205/1/T, Beside HDFC Bank, Opp: Land Mark Towners, Bachupally Road, Madinaguda, Serlingampally, Rangareddy District without following the due procedure as contemplated under law and also without taking any consent from the individual flat owners or the Association of the Apartment as illegal and arbitrary and void abinitio and besides violative of principles of natural justice and pass such other order or orders as deemed fit in the circumstances of the case and in the interest of justice."

When the matter is taken up for hearing, it is informed by the learned counsel for the petitioners that the petitioners have made a representation, dated 08.01.2017, to respondent No.2 herein informing the same grounds raised in this writ petition, but till date, respondent No.2 has not taken any decision and hence, requested the Court to direct respondent No.2 to consider the said representation and pass appropriate orders in accordance with law.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, respondent No.2 is hereby directed to consider the representation, dated 08.01.2017, of the petitioner and pass appropriate orders in accordance with law, as expeditiously as possible, preferably, within a period of eight (8) weeks from the date of receipt of a copy of this order after giving an opportunity of hearing to the petitioners.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
