HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN ARBITRATION APPLICATION No.69 OF 2015 ORDER:

This is an application for appointment of an Arbitrator seeking requisite measure under Section 11(6) of the Arbitration and Conciliation Act, 1996 (for short 'Act').

2. No counter affidavit is placed on record though Sri Suresh Kalava, Advocate, has made appearance for the respondent on 26.06.2015 itself.

3. Hearing the learned counsel for the applicant, it is seen that Clause 'X'

of the tender agreement provides for arbitration.

Thus, there is an arbitration agreement in terms of the Act. There are disputes between the parties. Hence, there is necessity to appoint an arbitrator.

4. Hence, this Arbitration Application is allowed appointing Sri K.Sanga Reddy, Retired District Judge, Flat No.108, Babu Khan Aneesha Towers, Walker Town, Padmarao Nagar, Secunderabad, as Arbitrator to arbitrate on the disputes between the applicant and the respondent and the said Arbitrator shall enter on reference and proceed with, as enjoined by the Act.

As a sequel thereto, Miscellaneous Applications, if any, pending in the Arbitration Application stand closed.
