THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13252 OF 2025 ORDER :

This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, by the petitioner/A.1 seeking anticipatory bail in connection with Crime No.195 of of Dandepalli Police Station, Ramagundem District.

The offences alleged against the petitioner are under Sections 318 (4) and 316(5) of Bharatiya Nyaya Sanhita, 2023.

The case of the prosecution is that the complainant who is the Mandal Education Officer, Dandepalli gave a report on 17.09.2025 stating that the petitioner who was an Ex-Special Officer, KGBV Dandepalli along with A.2 cheated and misappropriated an amount of Rs.5,46,760/- of the Government wherein they have maintained second register for actual receipt of provisions but payments were made only as per the attendance of the students but not as per the receipt of provisions and that records are also not maintained properly. Hence, the accused have misused the public money for their personal gains. As such, requested the police to take necessary

- 2 - action against the accused, basing on which the police registered the case against the accused for the above offences. 3.

Heard Sri A. Abhinandhan Reddy, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that petitioner is falsely implicated in this case and she was already suspended from the post for which she filed W.P.No.21088 of 2025 challenging her termination and this Court granted interim orders directing the concerned authorities not to fill up the post of Special Officer, KGBV, Dandepally and the same was extended until further orders. The allegation against the petitioner herein that she mis-appropriated an amount of Rs.5,46,760/- is only to harass her. Petitioner is innocent of the said allegations and she is working in the said school from the year 2013 and there are no complaints against her from the last 12 years. As such, requested the Court to grant anticipatory bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail stating that petitioner being a public servant, involved in mis-appropriation of amount to a tune of

- 3 - Rs.5,46,760/- and it requires custodial interrogation. Hence, petitioner is not entitled for bail and prayed to dismiss this petition.

Considering the submissions made by both the counsel and the material on record the allegation against the petitioner is that she mis-appropriated an amount of Rs.5,46,760/- by maintaining a second stock register with false numbers and further, she is already suspended from school and departmental enquiry is also pending against her. As such, there is no threat of tampering with the record. Hence, considering the facts and circumstances, this Court deems it fit to grant bail to the petitioner subject to the following conditions : i.

The petitioner/A.1 shall surrender before the Station House Officer, Dandepalli Police Station, Ramagundam District, within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioner on bail on her executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for the like sum each.

ii.

The petitioner/A.1 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/A.1 shall abide by the other conditions stipulated in Section 482(2) of

- 4 - BNSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
