HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 29426 of 2018 ORDER:

The present writ petition came to be filed seeking issuance of writ of mandamus to declare the action of the 3rd respondent in not mutating the names of the petitioners in the revenue records and not issuing pattadar passbooks and title deeds in respect of the land in Sy.No. 469, admeasuring Ac.5-38 guntas, situated at Tegadapally village, Jaipur Mandal, Mancherial District, by considering the petitioners' representation dated 03.02.2018, as illegal, arbitrary and unconstitutional.

The learned counsel for the petitioners submits that apart from making the representation dated 03.02.2018, they also filed an application under Section VI-A of the T.S. Rights in Land and Pattadar Passbooks Act, which is also not considered by the respondents.

The learned Government Pleader for Revenue would submit that there is any amount of doubt with regard to the application filed by the petitioners, as it does not contain the endorsement of any government authority, evidencing making of such an application.

Having regard to the above, the present writ petition is disposed of with consent, at the admission stage, directing the respondents to consider the application filed by the petitioners under Section VI-A, if the same is made in accordance with law and if no such application is made, the petitioners are at liberty to make a fresh application under Section VI-A of the T.S. Rights in Land and Pattadar Passbooks Act seeking mutation of lands, in which event, the authorities shall deal with the same and pass appropriate orders in accordance with law, as expeditiously as possible, preferably, within a period of three months from the date of making such application. There shall be no order as to costs. 5.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
