This Civil Revision Petition (CRP) is filed against Order, dated 04-07-2018, in EA.No.2 of 2018 in EP.No.37 of 2016 in OS.No.218 of 2015 on the file of the Special Sessions Judge for Trial of Cases under SC and ST (POA) Act -cum- XI Additional District Judge, Visakhapanam.

I have heard the learned Counsel for the petitioner and perused the record.

Admittedly, EA.No.2 of 2018, filed for setting aside the ex parte Order, dated 03-04-2017, in EP.No.37 of 2016 is beyond the limitation period of 30 days and the petitioner failed to file any Application under Section 5 of the Limitation Act, 1963, for condonation of delay. Hence, the Court below is justified in dismissing EA.No.2 of 2018 and I do not find any reason to interfere with the order of the lower Court.

This CRP is, accordingly, dismissed.

As a sequel to dismissal of the CRP, IA.No.1 of 2018, filed by the petitioner for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 31st August, 2018 lur
