HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 4020 of 2016 ORDER:
Heard learned counsel for the petitioner and the Government Pleader for Land Acquisition appearing for respondent Nos.1 to 3. The petitioner claims to be exclusively entitled to seek compensation for the land acquired by the Government, on the basis of the orders passed by the then Revenue Divisional Officer, Jangareddigudem, West Godavari District, in ROC No.555/2011, dated 03.09.2011. However, she has been given a notice of award asking to submit the relevant documents before the Special Deputy Collector (Land Acquisition), Polavaram Irrigation Project, Eluru, 3rd respondent herein. The notice is dated 23.09.2015. The petitioner claims to have appeared before the 3rd respondent and produced the documents. Alleging that no compensation is paid, the present writ petition is filed.
I do not see any reason for the petitioner to approach this Court disputing the claim of the 4th respondent. Since the said issue is already pending consideration before the 3rd respondent, as per the notice issued by him on 23.09.2015 and the petitioner claims to have appeared before the 3rd respondent and produced the documents, it is for the 3rd respondent to take an appropriate decision about the entitlement of the persons to claim compensation. Accordingly, the Writ Petition is disposed of directing the 3rd respondent to take an appropriate decision, in pursuance of the notice issued by him on 23.09.2015 and communicate the same to
the parties. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand dismissed.
