HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.29354 of 2018 ORDER:

1) Heard learned counsel for the petitioner and Government Pleader for Revenue (AP). With the consent of both the parties, the writ petition is disposed of at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents herein in trying to dispossess the petitioner from her agricultural land admeasuring Ac.0.80 cents in Sy.No.29, Boduvalasa Village, Sabbavaram Mandal, Visakhapatnam District, without following due process of law, as illegal, arbitrary and unconstitutional. 3) The Government Pleader for Revenue, on instructions, states that the assignment patta which is placed on record is invented and that the revenue record does not anywhere indicate issuance of the same. She further contends that the land which is subject matter of dispute is Konda Vagu Poramboku land and the petitioner has un-authorisedly encroached upon the government land by laying a foundation. The same is disputed by the learned counsel for the petitioner stating that the writ petitioner is in possession of the same.

4) Having regard to the facts and circumstances of the case and without going into the merits of the case, the present writ petition is disposed of, directing the respondents to follow due

process of law in dispossessing the petitioner from the subject land, if the petitioner is in possession of the same. No order as to costs.

5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
