THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13312 of 2025 This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused in FIR No.995 of 2025 of Raidurgam Police Station, Cyberabad, registered for the offences punishable under Sections 69 and 308(2) of the BNS. 2.

The brief facts of the case are that on 15.09.2025, the de-facto complainant lodged a report before the police stating that she met the petitioner/accused in June 2021 at a gym and developed a close friendship. The accused expressed his love for the complainant and promised to marry her. Trusting him, she left her husband and children to live with him. During their relationship, the accused took advantage of her, borrowed Rs.15,00,000/- on the pretext of starting a business but never returned it and also took her car (BR No. TS07C7477) without giving it back. The accused frequently beat and tortured her and maintained a relationship with another woman. When confronted about marriage, he abused, assaulted and threatened her. On 26.07.2025, the complainant left due to his cruelty but he continued to threaten her when questioned about marriage. Hence, she requested to take necessary action. Basing on the said complaint, the police registered a case for the above said offences.

Heard Sri K.Rajashekar, learned counsel appearing on behalf of the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged offence. Further, the relationship between the petitioner and the complainant was consensual. The de-facto complainant herself admitted that she is a married woman and there is no divorce. Therefore, there is no question of any promise by the petitioner to marry the complainant. The petitioner has been in jail since 25.09.2025. The material part of the investigation has already been completed. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner are serious and grievous in nature. It was submitted that the petitioner exploited the de-facto complainant by making a false promise of marriage and also took an amount of Rs.15,00,000/- from her. Therefore, he prayed the Court to dismiss the criminal petition. 6.

Considering the submissions made by both learned counsel and upon perusal of the material on record, it appears that, according to the de facto complainant, the petitioner and complainant have been in a relationship since 2021. She is a married woman having children

and there is no material on record that she gave divorce to her husband. Therefore, there is no question of a promise of marriage in relation to the said relationship. Having regard to the facts and circumstances of the case, this Court finds it appropriate to grant bail to the petitioner/accused, subject to the following conditions. i.

The petitioner/accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned XIII Additional Judicial Magistrate of First Class, Ranga Reddy District at Rajendranagar.

ii.

The petitioner/accused shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner/accused shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).
