HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25010 OF 2017 ORDER:

Heard learned counsel for petitioner and learned standing counsel for respondents.

It is the case of the petitioner that her husband, who was a non-departmental labourer, met with a fatal electrical accident and died instantaneously due to electric shock on 06.11.2014 while he was attending motor repair to run the pumpset. A case in F.I.R.No.143 of 2014 was also registered on 14.11.2014. The Post Mortem Report also indicated that the deceased died due to electric shock. The final investigation report submitted before the Hon'ble Executive Magistrate, Besthavarapeta Mandal, Prakasam District also concluded that he died due to electric shock. The petitioner submitted a representation on 04.08.2016 for sanction of ex gratia before the respondents and a complaint was also lodged before the Hon'ble Lokayukta, Hyderabad and later on it was withdrawn. When no action was taken pursuant to the Office Order, dated 26.10.

2013 issued by the Southern Power Distribution Company of A.P. Limited, the present writ petition is filed. In view of the facts stated above, this writ petition is disposed of with a direction to the first respondent to consider the case of the petitioner for payment of ex gratia in accordance with the orders passed by the second respondent from time to time dealing with the said cases and pass appropriate orders within a period of three months from the date of receipt of a copy of this order.

Consequently, miscellaneous petitions pending, if any, shall stand closed.
