THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13761 of 2024 ORDER:
Seeking the Court to enlarge the petitioner who is arrayed as accused No.1 in Crime No.421 of 2024 of Hanamkonda Police Station, Warangal District, on bail, the present Criminal Petition is filed.

The brief facts of the case are that on 29.09.2024, at 13:00 hours, complainant filed a petition at Hanumakonda Police Station, alleging that Avula Chiranjeevi/accused No.1 deceived and exploited her emotionally and financially. They met in the month of December 2019 through Thammishetty Shiva, and Chiranjeevi promised marriage. Despite the disapproval of her parents, she left her job in Vishakapatnam and moved to Hanamkonda with him. Chiranjeevi introduced her to his parents, who assured marriage would take place in 2020. However, he repeatedly delayed marriage, using her earnings and gold ornaments for his family's needs. They lived together, and she started a fashion designing institute. On 08.08.2024,
Chiranjeevi married Ravali without disclosing his prior relationship. When confronted, family members of accused No.1 i.e., accused Nos.2 to 5 abused, beat, and threatened her.

Heard Sri B. Balaji, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Manoon, learned Additional Public Prosecutor appearing on behalf of the respondent.

Learned counsel for the petitioner submitted that the relationship between the petitioner and the de facto complainant was consensual, with the complainant being an adult and older than the petitioner. They also highlighted a partnership business between parties, where petitioner holds a 60% share, eliminating any possibility of exploitation. He further submitted that the complainant filed a false report with vague allegations, urging the Court to grant bail to the petitioner by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the bail petition stating that the investigation is under progress and the offences alleged against the petitioner
are serious in nature, as such, he prayed the Court to dismiss the criminal petition.

After reviewing submissions made by both the learned counsel and perusing the record, the allegations leveled against the petitioner is that he is misusing his relationship with the de facto complainant and subsequently cheating her. Considering the substantial completion of investigation and the incarceration of the petitioner since 30.10.2024, the Court deems it fit to grant bail with the following conditions: i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned II Additional Judicial Magistrate of First Class, Hanumakonda.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks, for purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
