ORDER:

This writ petition is filed for a mandamus to set aside proceedings, dated 18.07.2011, of respondent No.1, whereunder he has selected and appointed respondent No.3 as the permanent fair price shop dealer of Aravakuru Village, Kuderu Mandal, Anantapur District.

At the hearing, there is no representation for the petitioner. In pursuance of the notification issued by respondent No.1, the petitioner as well as respondent No.3 applied for appointment as the permanent fair price shop dealer of Aravakuru Village. Respondent No.1 held oral interviews and assigned marks to all the fifteen candidates, who attended the interviews. A perusal of the impugned proceedings issued by respondent No.1 shows that while the petitioner has secured 13 marks, respondent No.3 has secured 19

marks, out of 25 marks. Therefore, respondent No.1 has appointed respondent No.3 as the permanent fair price shop dealer.

In the light of the fact that respondent No.3 has secured six marks more than the marks secured by the petitioner, I do not find any illegality in the appointment of respondent No.3. The only ground on which the petitioner has questioned the appointment of respondent No.3 is that the father of respondent No.3 was involved in a criminal case. In my opinion, involvement of the father in a criminal case does not disqualify his son for being appointed as the permanent fair price shop dealer. Hence, I do not find any merit in the writ petition. The Writ Petition is accordingly dismissed.

As a sequel to the dismissal of the writ petition, W.P.M.P.No.29617 of 2011 filed by the petitioner for interim relief shall stand dismissed as infructuous. __________________________ C.V.NAGARJUNA REDDY, J 07th October, 2015 GHN
