SMT JUSTICE T. RAJANI CRIMINAL PETITION No.1741 of 2013 ORDER:

The criminal petition is filed for quash of the proceedings in C.C.No.821 of 2012 on the file of the X Additional Chief Metropolitan Magistrate, Secunderabad.

Heard the counsel for the petitioners and the learned Public Prosecutor appearing for the first respondent. 3.

The counsel for the petitioners submits that the dispute is civil in nature and therefore, seeks to quash the proceedings in C.C.No.821 of 2012. He also seeks a direction to the Court below not to insist upon the presence of petitioners. 4.

Though the dispute is civil in nature, the genesis of the complaint is that the petitioners are alleged to have gone to the house of the defacto-complainant and beat the defactocomplainant. Therefore, the proceedings against the petitioners cannot be quashed.

Hence, the criminal petition is dismissed.

However, considering the request of the counsel for the petitioners, the Court below is directed not to insist upon the presence of petitioners unless it is necessary for the proceedings.
