THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM C.C.C.A.No. 54 OF 2003 JUDGMENT:
The appeal was listed on 21.11.2017. Since there was no representation on behalf of the appellants, it was directed to be listed after three weeks. Thereafter, the matter was listed on 12.12.2017, on which date, at request of learned counsel for the appellants, the matter was adjourned to 19.12.2017. On 19.12.2017, on noticing that the impleaded respondent filed a Memo on 15.12.2017 stating that he paid the entire amount to the respondent-Bank, the matter was adjourned to today under the caption 'for dismissal'. Even today, there is no representation on behalf of the appellants.
Taking into consideration the fact that the appellants themselves, being judgment debtors, filed this appeal questioning the judgment and decree, dated 06.08.2002, passed in O.S.No.1145 of 1995 on the file of V Senior Civil Judge, City Civil Courts, Hyderabad, in favour of the respondent-Bank, and as on today, the claim of the Bank being satisfied, as evident from the Memo, dated 15.12.2017, nothing survives in the appeal. Therefore, the appeal is dismissed as infructuous. Consequently, miscellaneous applications, if any shall stand dismissed.
