THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.29459 of 2018 ORDER:

Heard learned Counsel for the petitioner and Sri D.Ramesh, learned Standing Counsel for the respondentauthorities. A show cause notice issued under Section 115 (1) of the Andhra Pradesh Capital Region Development Authority Act, 2014 (hereinafter referred to as 'the Act') and the Order issued under Section 116 (1) of the Act, are challenged in the present Writ Petition.

During the course of arguments, it is brought to the notice of this Court that after the service of the impugned notices, the respondent-authorities instructed the petitioner to stop/remove further constructions and accordingly the petitioner removed the same and stopped further constructions.

Since the notice, dated 23.07.2018, is a show cause notice and as according to the learned Standing Counsel, no final orders have been passed so far, this Court deems it appropriate to dispose of the Writ Petition, permitting the petitioner to submit explanation to the show cause notice, dated 23.07.2018, within a period of two weeks from the date of receipt of a copy of this Order, and if any such explanation is filed, the same be considered and appropriate Orders be passed, strictly in accordance with law. Till the said exercise attains finality, no further coercive action in respect of the subject structure shall be taken by the respondents.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed. There shall be no order as to costs.
