THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.NO.8412 OF 2016

O R D E R

This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.202 of 2014 on the file of XVII Metropolitan Magistrate, Cyberabad at Rajendranagar, Hyderabad registered against the petitioner, who is accused No.2, for the offence punishable under Sections 498-A and 406 IPC and Sections 3 and 4 of Dowry Prohibition Act. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.

A perusal of the material on record reveals that specific allegations were made against the petitioner. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings.

In the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the criminal petition is disposed of, directing the trial court to dispose of the case as expeditiously as possible, preferably within a period of six months from the date of receipt of a copy of this order, without insisting the presence of the petitioner on each and every date of hearing, except required for any specific purpose. Miscellaneous petitions pending if any, shall stand closed. No costs. ------------------------------ M.S.K.JAISWAL,J DATE:17.06.2016 AVS
