This writ petition is filed declaring the action of the 3rd respondent in issuing impugned notice in Rc.No.49/2016, dated 08.05.2016 under Section 7 of Land Encroachment Act 3 of 1905 (for short 'the Act') in respect of house bearing No.15/195-6A situated at Kutagallu, Kadiri Municipality, Anantapur District, as illegal and arbitrary and to set aside the same.
Learned counsel for the petitioner submits that in pursuance to the notice dated 08.05.2016, the petitioner submitted his explanation on 19.05.2016. But the 3rd respondent without passing any orders under Section 6 of the Act, is trying to evict the petitioner. Heard learned Assistant Government Pleader for Revenue. Since notice has already been issued by the 3rd respondent and petitioner had filed explanation, it is open for the petitioner to raise all his objections before the 3rd respondent and the 3rd respondent shall consider the same and pass orders in accordance with law. Till then, status-quo obtaining as on today shall be maintained. Accordingly, the writ petition is disposed of. There shall be no order as to costs.
