CVNR, J & GSP, J WP.No.34051 of 2015 Dt: 29.09.2016 Order: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Petition is filed for the following substantive relief:
"Issue writ order or direction more particularly one in the nature of writ certiorari by calling the records in SA No.303 of 2014 on the file of Hon'ble Debt Recovery Tribunal, Visakhapatnam and set aside the order dated 30-09-2015 as illegal, unjust, arbitrary, null, void, unconstitutional and against the principle of natural justice."
At the hearing, the learned Counsel representing Mr.PAV.Bala Prasad, learned Counsel for the petitioner, submitted that since the auction purchaser has withdrawn from the auction process, the cause in this Writ Petition does not survive for adjudication and that therefore, the petitioner seeks to withdraw the Writ Petition.
The learned Counsel for the respondent did not oppose the said request.
In view of the same, the Writ Petition is dismissed as withdrawn.
As a sequel to dismissal of the Writ Petition, interim order, dated 13-10-2015, as extended from time to time, is
CVNR, J & GSP, J WP.No.34051 of 2015 Dt: 29.09.2016 vacated and WPMP.No.43847 of 2015 is disposed of as infructuous.
