O R D E R
The grievance of the petitioners in this case was that the police authorities were summoning them to the Police Station during every election in the locality only on the ground that they were the accused in C.C.No.60 of 2006 on the file of the Judicial Magistrate of First Class, Alamuru.
Though a counter-affidavit was filed in the year 2013 by the Sub-Inspector of Police, Mandapeta Town Police Station, East Godavari District, the learned Assistant Government Pleader for Home was asked to get instructions as to the present status. Thereupon, the Assistant Sub-Inspector of Police, Mandapeta Rural Police Station, East Godavari District, addressed written instructions dated 06.06.2015 to the office of the learned Government Pleader for Home, wherein he stated that the petitioners were earlier involved in Crime No.118 of 2005 which was registered under Sections 353 and 427 IPC read with Section 34 IPC on the file of the Mandapeta Rural Police Station. However, they were acquitted after full trial in C.C.No.60 of 2006 by the learned Judicial Magistrate of First class, Alamuru.
Only on the ground of their involvement in the aforestated case they were stated to have been bound over during the 2009 Cooperative Society Elections. The Assistant Sub-Inspector of Police further stated that the police had not summoned the petitioners to the police station thereafter. The aforestated stand of the police authorities is taken on record. In the light thereof, the grievance of the petitioners no longer survives for consideration on merits.
The writ petition is accordingly closed. Pending miscellaneous petitions shall also stand closed. No order as to costs.
