PNR, J C.C. (TR.) No.51 of 2017 ORDER:

This contempt case is filed alleging that even though the circular memo dated 23.07.2012 was suspended; final seniority list was published violating the directions issued by the Tribunal. Petitioner alleges that, on 12.04.2013, the Engineer-in-Chief issued circular memo, informing the employees that final seniority list was published vide office circular memo dated 26.02.2013, which would supersede earlier circular memo dated 30.03.2010. As seen from the record, though office circular memo was issued on 12.04.2013, para-6 of the memo would show that final seniority list was published on 26.02.2013 and by this memo, the Engineer-in-Chief only informs of such publication. The interim order was passed by the Tribunal on 07.03.2013, i.e., after 26.02.2013.

When it is pointed out, learned counsel for the petitioner fairly submits that final seniority list was published prior to the interim order of the Tribunal. Having regard to the same, it cannot be said that respondents violated the orders of the Tribunal, warranting initiation of proceedings under the Contempt of Courts Act, 1971.

Contempt Case is accordingly dismissed.
