HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.29309 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 3rd respondent in not issuing the pattadar passbook, raithu bandhu cheques to the petitioner pertaining to the land admeasuring Ac.03.00 gts situated at Sy.No.237 of Jangampally Village, Bhiknoor Mandal, Kamareddy District, as illegal and arbitrary. When the matter is taken up for hearing, learned Government Pleader for Revenue placed on record the written instructions received from Tahsildar (FAC), Bhiknoor Mandal. As per the said instructions, the subject land is Government land in classification and situated at Jangampally Village of Bhiknoor Mandal and the land in the said survey number was assigned to the landless poor persons earlier.

It is further stated that a perusal of the revenue records, would reveal that, the name of the petitioner which was entered in the pahani for the year 2014-15 is an irregular entry and it was recorded without any remarks/proceedings of the concerned authority. The Khatha number No.637, which was recorded against the name of the petitioner is also an irregular one. On verification of ROR 1-B register, it is revealed that, the Khatha No.637 is an existing Khatha, which was already allotted to another pattadar.

It is also stated that during the LRUP programme, the petitioner has filed an application for issuance of new pattadar passbook and rythubhandhu cheque for the subject land and the matter has been enquired by the Mandal Incharge, Girdawar and Village Revenue Officer concerned who submitted a report stating that, the petitioner is not in possession over the subject land and that she was never in possession earlier also.

programme and the same came to be rejected, the request of the petitioner in this writ petition cannot be accepted. Accordingly, the writ petition is dismissed. However, the 3rd respondent shall furnish a copy of the report submitted by the Mandal Incharge and Village Revenue Officer to the petitioner, in which event, the petitioner shall take steps in accordance with law. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
