THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.12149 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/accused seeking anticipatory bail in the event of his arrest in connection with F.I.R No.69 of 2023 dated 11.02.2023 on the file of the Balanagar Police Station, Cyberabad, registered for the offence punishable under Sections 403, 406, 420, 467, 468, 471 and 120b of Indian Penal Code (for short 'IPC'). 2.

Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the respondent-State and perused the record.

private complaint was filed by the authorized representative of M/s. Akzonoble India Limited. In the said complaint, it is stated that certain goods which had to be delivered to its customers was diverted and the goods were misappropriated.

The worth of the goods is around Rs.39.00Lakhs.

On the basis of the said complaint which was referred to the police for investigation, a crime was registered.

Learned counsel for the petitioner would submit that all the transactions pertain to the year 2021. After 11⁄2 years the petitioner had left the organization, the complaint is filed. 6.

There is no explanation for the delay of nearly two years in lodging the complaint. Further, the alleged misappropriation was in September, 2021.Keeping in view that the role of the petitioner and the entrustment of the goods by the company would be subject matter of documents, this Court is inclined to grant the relief of anticipatory bail, subject to the following conditions:

1) The petitioner/accused is directed to surrender before the Station House Officer, PS, Balapur, on or before 20.12.2023. Upon such surrender, the said Station House Officer shall release the petitioner/accused on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/accused shall appear before the concerned police on every Monday between 10am to 12pm for a period of eight (08) weeks and thereafter, as and when required for the purpose of investigation.

3) The petitioner/accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
