HONOURABLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.10577 OF 2015 ORDER:
Heard.
The petitioners' seek mandamus against respondents 3 and 4 alleging that respondents 3 and 4 are pressurizing them to settle the civil dispute, which is the subject matter of O.S. No.199 of 2015 pending before the IV Additional District Judge, Ranga Reddy District.
Learned Government Pleader has received instructions, which state that the 5th respondent filed the complaint dated 21.02.2015 before the Commissioner, Telangana SC & ST Division, which was forwarded to the Commissioner of Police Hyderabad on 25.02.2015 and inturn, the same was sent to the Assistant Commissioner of Police, Rajendranagar for enquiry and necessary action. After conducting preliminary enquiry, Crime No.189 of 2015 is stated to have been registered on the file of Narsingi Police Station on 18.04.2015 and investigation is taken up, which is at a final stage as of now. It is also stated that the petitioners presence is required in connection with the above case and depending upon the evidence adduced during the investigation, appropriate steps will be taken in accordance with law after following due procedure. The instructions specifically stated that at no point of time the respondents 3 and 4 threatened the petitioners or asked them to settle the dispute with the 5th respondent.
In view of the specific instructions and since it is categorically stated that the respondents 3 and 4 have neither pressurized the petitioners nor have any role to play in settlement of civil dispute referred to by the petitioners, the respondents 3 and 4 shall confine their jurisdiction to the investigation of the
crime aforesaid and take appropriate action depending upon the result of the investigation.
Accordingly, the Writ Petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
