HONOURABLE SRI J USTICE A. RAMALINGESWARA RAO WRIT PETITION No. 2756 OF 2017 ORDER:

Assailing the action of respondents in not considering the application of petitioner dated 20.01.2016 and granting permission to construct mini cinema theatre in Sy.No.205/2 of Molluru village, Muthukuru Mandal, Nellore District the present Writ Petition is filed.

It is the case of petitioner that he intents to construct a mini cinema theatre in his land in Sy.No.205/2 of Molluru village, Mothukuru Mandal, Nellore District. Accordingly he made an application to the second respondent on 20.01.2016 as per the Cinema Regulation Act in Form A-1. It is submitted that fire authorities have recommended the case of the petitioner and issued No Objection Certificate in his favour to construct a cinema theatre. It is further submitted that the Government issued G.O.Ms.No.122, Home (General.

A) Department, dated 08.11.2016 providing single window clearance system for construction of Mini theatre and renewal of license. The petitioner submitted a representation on 21.12.2016 seeking to grant No objection Certificate for construction of Mini Theatre inasmuch as his earlier application is pending consideration with the respondents for the last one year. When no action is taken on his application dated 20.01.2016, the present Writ Petition was filed.

When the matter is taken up for consideration on 27.01.2017, the learned Government Pleader sought time to get instructions in the matter. To day when the matter is taken up consideration, the learned Government Pleader states that no instructions have been received.

Having regard to the submissions of learned Counsel on either side and in the facts and circumstances of the case, the Writ Petition is disposed of directing the second respondent to consider the application of petitioner dated 20.01.2016 for construction of mini cinema theatre and pass appropriate orders thereon, in accordance with law, within a period of thirty days from the date of receipt of a copy of this order, if not already disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
