The grievance of the petitioner in this case was that the police authorities were not initiating action against respondents 7 to 9 in spite of his complaint.

Relying upon the written instructions dated 16.06.2015 received from the Assistant Sub-Inspector of Police, Penugonda Police Station, West Godavari District, the learned Assistant Government Pleader informed this Court that upon the petitioner's private complaint before the learned II Additional Judicial Magistrate of First Class, Tanuku, which was forwarded to the Penugonda Police Station, Crime No.89 of 2011 was registered under Sections 420 and 506 I.P.C. against the 7th respondent herein. Investigation however revealed that there was a civil dispute between the complainant and the accused which was pending before the learned Senior Civil Judge, Tanuku, in O.S.No.27 of 2011. As there was no evidence of any criminal offence having been committed, final report was filed before the learned II Additional Judicial Magistrate of First Class, Tanuku, to the effect that the case was false.

Notice was also said to have been given to the petitioner/complainant.

In the light of the afore-stated facts, it is for the petitioner, if he is aggrieved by the final conclusion arrived at by the police authorities, to take recourse to appropriate remedies in accordance with law.

Reserving liberty to the petitioner to do so, the writ petition is dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
