THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4034 OF 2016 ORDER:
This petition is filed by the petitioners-accused Nos.1 to 10 under Section 482 Cr.P.C. seeking to quash the proceedings against them in C.C.No.1073 of 2015 on the file of the Judicial First Class Magistrate, Tandur, Ranga Reddy District.
The petitioners are alleged to have committed the offence punishable under Sections 420, 494, 406, 120(B), 506 and 108 r/w 34 IPC. It is alleged that the 2nd respondent is the wife of the 1st petitioner. The petitioners are harassing the 2nd respondent for additional dowry and they necked out the 2nd respondent from matrimonial house. The family members of A1 performed the marriage of A1 with A6. When she questioned the accused, they threatened her.
Heard and perused the material available on record. Considering the facts and circumstances of the case and the averments in the charge sheet, this Court is not inclined to grant the relief sought by the petitioners.
At this stage, the learned Counsel for the petitioners prayed for dispensing with the presence of the petitioners before the trial Court. In view of the above submission, the presence of the petitioners No.2 to 10 before the trial Court is dispensed with except on the dates when their presence is specifically required by the trial Court. The 1st petitioner is directed to appear before the trial Court regularly on all hearing dates and represent petitioners No.2 to 10 in the above C.C. Accordingly, the Criminal Petition is disposed of. Consequently,
