HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.29543 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the respondents 2 and 3 in not receiving the documents presented by the petitioner for registration in respect of plot No.85 of Sunrise Homes Township, Upperpally Village, G.H.M.C, Rajenderanagar Circle, Ranga Reddy District, as illegal and arbitrary. The grievance of the petitioner is that he is a lawful owner and possessor of the subject plot having purchased the same through a registered sale deed dated 10.02.2004, and since then, the petitioner has been in continuous peaceful possession and enjoyment of the same, without there being any interruption.
While things stood thus, due to personal necessities, now the petitioner wants to sell the subject land and thereby approached the 3rd respondent and presented the documents in the month of August, 2018 for registration, who in turn refused to receive the same without assigning any reasons. Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 3rd respondent-Sub Registrar, to receive the documents for registration, if they are in accordance with the law. However, if the 3rd respondent is not satisfied with the documents presented by the petitioner for registration, the 3rd respondent, shall return the same assigning reasons, as early as possible, preferably within a period of two to four weeks from today, by giving reasonable opportunity of hearing to the petitioner and all concerned.
With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
