THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD WRI T PETI TI ON No.31059 of 2015 ORDER: (per SK,J) This writ petition was filed primarily against the auction/tender notice dated 09.09.2015 issued by the Andhra Bank in relation to the secured assets belonging to the petitioners.

The conditional interim order dated 23.09.2015 granted by this Court was admittedly not complied with.

It is now stated by Sri V.Raghu, learned counsel for the respondent-Andhra Bank, that the proposed auction pursuant to the sale notice dated 09.09.2015 did not materialise for want of bidders. That being so, the challenge in this writ petition is rendered purely academic and does not warrant consideration on merits. The writ petition is accordingly dismissed leaving it open to the petitioners to invoke appropriate remedies available to them in law as and when a fresh cause of action arises. All issues are left open. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
