At the time when the matter is taken up for hearing, it is submitted by the learned counsel for the petitioner that both parties are enjoying their respective rights over the properties and the impugned proceedings issued by the 2nd respondent under Section 145 Cr.P.C., must have lapsed long back, thereby, the cause in the writ petition may not survive for adjudication. Recording the submission made by the learned counsel for the petitioners, the Writ Petition is closed giving liberty to initiate fresh action if the situation warrants. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. No order as to costs.
