THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI CONTEMPT CASE No.575 of 2015 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) This contempt case was instituted alleging willful disobedience to the order dated 26.03.2015 passed by this Court in WPMP No.10841 of 2015 in WP No.8228 of 2015.
This contempt is alleged against Smt. Alivelu Manga Tayaru, the Commissioner of Nalgonda Municipality.
It is fairly stated by the learned counsel for the petitioner that pursuant to the order dated 29.03.2015 passed by this Court in the present contempt case, the school premises was opened by removing the seals and that there was no further interference by the municipal authorities in violation of the order passed by this Court. Though we are of the opinion that the conduct of the respondent Commissioner was not beyond reproach and that being a Senior Officer of the State, she ought to have acted in a more responsible manner when informed of the fact that this Court had passed an order restraining her from taking coercive measures, we find no element of willfulness in her conduct warranting exercise of contempt jurisdiction. We therefore close the contempt case cautioning the respondent to be more mindful of the seriousness of her responsibility and to be more careful in discharge thereof in future. No order as to costs.
