THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13809 of 2024 ORDER:

Seeking the Court to enlarge the petitioner who is arrayed as accused in Crime No.512 of 2024 of Osmania University Police Station, Hyderabad, on bail, the present Criminal Petition is filed.

The brief facts of the case are that on 28.10.2024, the mother of the victim filed a complaint stating that her elder daughter had been harassed by an unknown person who followed her from school, demanding her phone number. Despite attempts to catch him, he escaped. However, on 28.10.2024, the family apprehended the perpetrator near their residence while he was harassing their daughter again. Upon inquiry, his identity was revealed as Bharath Simha/petitioner. Based on this complaint, the police registered Crime No. 512/2024.

Heard Sri V. Raghunath, learned Senior Counsel representing Sri K. Ajith Reddy, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Manoon,

learned Additional Public Prosecutor appearing on behalf of respondent-State.

Learned counsel for the petitioner submitted that the alleged offenses carry sentences below seven years, and since the petitioner has been in jail from 31.10.2024, with poor health, immediate medical treatment is necessary, and he filed the medical reports to that effect. He further submitted that the petitioner was assaulted by the relatives of the victim, yet the police ignored his complaint. Considering the health condition of the petitioner, learned counsel urged the Court to grant bail to the petitioner by allowing this criminal petition. 4.

Learned Additional Public Prosecutor opposed the bail application of the petitioner stating that the investigation is not yet completed and there are serious allegations against the petitioner, if the petitioner is released on bail, there is every chance of threatening the victim, therefore, he prayed the Court to dismiss the criminal petition.

After considering the submissions made by both the learned counsel and reviewing the record, it appears that the alleged offenses against the petitioner carry sentences below seven (7) years. Further, the petitioner is in jail from

30.10.2024, and the petitioner need for medical treatment as evidenced by medical records, this Court deems it fit to grant bail to the petitioner with the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned IV Additional Chief Judicial Magistrate of First Class, Nampally.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
