THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.1052 of 2010 ORDER:

This Writ Petition is filed for the following relief. "... to issue an appropriate Writ, Order or direction more particularly a Writ in the nature of Mandamus declaring the action of the respondents in not issuing Sand quarry for sand Reach in Godavari River 47, VLB from KM to 48.400 KM to 50.000 KM Ramp point at 57.800 KM - 58/900 KM (by Boats) near Tatipaka Village Razole Mandal, East Godavari District on the allegation that the petitioner society not paid 3rd installment on or before 07-10-2009 the said condition is not in accordance with agreement dated 1605-2009 and contrary to the A.P Minor Mineral Concession Rules 1966, 9-C(I) Special Concession Rules,1966, 9-C (I) Special Concession to Boatsmen Co-Operative Societies as illegal, arbitrary, violative of A.P Minor Mineral Concession Rules, 1966 and violation of principles of natural justice and pass order or orders as this Hon'ble Court may deem fit in the circumstances of the case." In view of the expiry of period of lease, nothing survives for adjudication in this Writ Petition.

Hence, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.

The miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
