HON'BLE SRI JUSTICE R. SUBHASH REDDY CIVIL REVISION PETITION No.4030 of 2015 ORDER :

This civil revision petition is filed under Article 227 of the Constitution of India, by the defendants in the suit in O.S.No.484 of 2014, aggrieved by docket order, dated 27.08.2015, passed by the learned XI-Additional Chief Judge, City Civil Court, Hyderabad, in the said suit.

It is the submission of learned counsel for petitioners that though Ex.A-1 is an unregistered mortgage deed, which is not admissible in evidence, the same is marked without giving any opportunity to them.

It is always open for the petitioners to raise the aforesaid objection before the Court below, and if any such objection is raised, the same may be considered at the time of disposal of the suit, but at the same time, I do not find any ground to interfere with the impugned order, at this stage.
