HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE WRIT PETITION No. 18516 OF 2010 ORDER: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Learned counsel for the petitioner submits that he is not getting any instructions from his client.

I have perused the prayer made in the writ petition whereby the petitioner seeks to challenge the action of respondent Nos.2 and 3 in cancelling the contract awarded to him under the tender notice dated 17-11-2008 without issuing prior notice to him and forfeiting EMD amount of Rs.11,800/- as illegal and arbitrary and seeks direction to pay EMD amount and Rs.1,00,000/- as damages.

From bare perusal of the prayer itself it is clear that such relief cannot be sought in writ petition under Article 226 of the Constitution of India. That apart, the respondents have denied the claim of the petitioner by issuing notice dated 22-122009. The contents of the notice show that the respondents do not admit the claim of the petitioner.

Keeping that in view and considering the nature of prayer made in the writ petition, writ petition deserves to be dismissed. Order accordingly. Miscellaneous petitions, if any, also stand disposed of. No order as to costs. _________________________ DILIP B. BHOSALE, ACJ 07-08-2015 ks
