THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.12157 OF 2023 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused Officer in Cr.No.6/RCT-KMM/2023 on the file of Anti Corruption Bureau (for short 'ACB'), Khammam Range, Khammam District, registered for the offences punishable under Sections 7(a) & 7(b) of Prevention of Corruption Act, 1988. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The petitioner was apprehended by the ACB for demanding and accepting for an amount of Rs.3,000/- from one Kakumani Mallikarjun for the purpose of releasing an amount of Rs.2,59,704/-, in connection with laying of CC road to an extent of 72.5 meters from SK.Madar (H) to Inukonda Mallaiah(H) at Nachepalli (V & GP), Nelakondapalli Mandal. The petitioner was caught red-handed in the office premises of the office of District Panchayat Raj Engineer, PIU,

Division, Khammam by the ACB and the amount was recovered from the petitioner.

Keeping in view that material part of the investigation is completed, this Court deems it appropriate to enlarge the petitioner on bail subject to the following conditions:

i) The petitioner/Accused Officer shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to the satisfaction of I Additional Special Judge for SPE&ACB Cases at Hyderabad. ii) The petitioner/Accused Officer, after release shall appear before the concerned Station House Officer as and when required, for the purpose of investigation.

iii) The petitioner/Accused Officer shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 5.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed. __________________ K.SURENDER, J Date: 13.12.2023 dsv
