HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.18323 of 2015 ORDER :

The grievance of the petitioners is that pensions earlier granted to them were abruptly stopped without assigning any reason and on account of such action, grave prejudice is caused to the petitioners. Petitioners being old aged persons, on account

of stoppage of pensions, they are put to great hardship and suffering.

2. Learned standing counsel representing the respondents submits that as per the scheme formulated in G.O.Ms.No.135 Panchayat Raj and Rural Development (RD.I) Department, Government of Andhra Pradesh, dated 17.09.2014, against any decision of Pension Committee, an appeal shall lie to the Mandal Pensions Committee. Petitioners have not submitted any appeal before the said Committee, but representation was submitted to the District Collector. The District Collector is no way concerned with the issue.

3. Having regard to the same, learned counsel for the petitioners submits that petitioners would be advised to prefer an appeal before the Mandal Pensions Committee against denial of pension to the petitioners. As and when such appeal is filed, the Mandal Pensions Committee shall consider the same and take appropriate decision as warranted by law as expeditiously as possible, preferably within a period of four weeks thereafter.

4. Accordingly, the writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. __________________________ JUSTICE P.NAVEEN RAO Date: 24.06.2015 kkm
