HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL REVISION CASE No.931 of 2017 ORDER :

Heard both sides and perused the impugned order. In fact the proposed accused to be impleaded is not shown as one of the respondents to the petition before the lower Court under Section 319 Cr.P.C. The 2nd respondent therein is in fact the driver of A1 and the accusation as co-accused, who contributed to the accident also at his negligence is against the lorry driver for the wrong parking unauthorizedly without blinking lights etc., Once such is the case, that lorry driver with name and particulars must be shown as respondent to the application.

Having regard to the above, the Criminal Revision Case is disposed of by giving liberty to file fresh application before the lower Court.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
