THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.15963 OF 2017 ORDER:
This Writ Petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue writ in the nature of mandamus declaring the action of the official respondents in proceeding to bifurcate the Petitioner Society in its back without giving an opportunity to the members of Society to submit their objections against the ineligible applicants, is arbitrary, discriminatory, colourable exercise of power, violative of principles of Natural Justice and Fundamental Rights guaranteed under Articles 14, 16, and 21 of the Constitution, and against the provisions of Cooperative Societies Act and Consequentially direct the Respondents to provide the information sought by the Petitioner Society vide their Letter dated 18-4-2017 and not to proceed without considering the objections of the members of the Society."

Heard the learned counsel for the petitioners and the learned Government Pleader appearing for respondents 1 to 4 and Sri P.V.Ramana, for respondent No.7.

The material available on record shows that the petitioners herein submitted a representation on 18.04.2017 to the 4th respondent requesting him to provide information. According to the learned counsel for the petitioners, no action has been taken on the said representation. A request is made by learned counsel for the petitioners to direct the 4th respondent to take action on said representation, dated 18.04.2017, in accordance with law.

On the other hand, it is submitted by learned Government Pleader that appropriate action would be taken on the said representation in accordance with law.

Recording the said submissions, the Writ Petition is disposed of, without expressing any opinion on the merits of the matter, directing the 4th respondent to take appropriate action on the representation, dated 18.04.2017, said to have been submitted by the petitioners, within a period of four (04) weeks from the date of receipt of a copy of this order, in accordance with law. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
