THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI APPEAL SUIT No.1210 of 1998 JUDGMENT:

There was no representation for the appellant on 18.01.2018. Therefore, this Court directed the Appeal Suit to be listed under the caption "for dismissal" on 24.01.2018. On 24.01.2018, 01.02.2018 & 08.02.2018, requests were made on behalf of the appellant for adjournment, and, therefore, the matter was being adjourned under the same caption. When the matter is listed today under the same caption, yet again, there is no representation for the appellant. The above conduct of the appellant indicates that the appellant is not interested in prosecuting the Appeal Suit.

In the result, the Appeal Suit is dismissed for default. There shall be no order as to costs.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
