THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Criminal Petition No.7250 of 2015 ORDER:

This petition under Section 482 of the Code of Criminal Procedure, 1973 ('the Cr.P.C' for brevity) is filed by accused nos.2 to 8 in CC.No.377 of 2014 on the file of the Court of the Judicial Magistrate of First Class, Alur requesting to quash the proceedings against them in the said Calendar Case.

Heard the learned counsel for the petitioners/A2 to A8 and the learned Additional Public Prosecutor representing the State. Perused the material record.

During the course of hearing, it is submitted by the learned counsel for the petitioners that the criminal petition may be disposed of by an appropriate order dispensing with the presence of the petitioners/ accused nos.2 to 8 before the trial court except on the dates when their presence is necessary.

4. Though this is not a fit case for quashing the proceedings, having regard to the facts and the submissions, this court is satisfied that the presence of the petitioners 1 to 4, 6 and 7/accused nos.2 to 5, 7 and 8 before the trial Court can be dispensed with.

In the result, the Criminal Petition is disposed of dispensing with the personal appearance of the petitioners 1 to 4, 6 and 7/accused nos.2 to 5, 7 and 8 in CC.No.377 of 2014 on the file of the Court of the Judicial Magistrate of First Class, Alur. However, they shall appear before the trial Court as and when directed by the trial Court. It is needless to mention that 5th petitioner/6th accused-Siva Reddy shall appear before

the trial Court along with A1 during the course of trial. Miscellaneous petitions, pending if any, in this criminal petition shall stand closed.
