THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9897 OF 2022 O R D E R:
This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused No.1 in Crime No.139 of 2022 pending on the file of Station House Officer, Indalwai Police Station, Nizamabad District registered for the offences punishable under Sections 307, 353 and 379 read with Section 34 of Indian Penal Code.

Heard learned counsel for the petitioner-Accused No.1 and learned Additional Public Prosecutor for the respondent-State. Perused the record.

Briefly the facts of the case are that, this petitioner and others were involved in theft and transport of sand illegally from the Reserve Forest Area. When confronted by the forest personnel, this petitioner and others attacked the public servants. 4.
Learned counsel for the petitioner submits that the petitioner is in jail since 16.09.2022 and all the other accused have been
released on bail. He also submits that the investigation is completed and charge sheet is also filed.

Keeping in view the completion of investigation, this petitioner can be granted the relief of regular bail. 6.
Accordingly, the Criminal Petition is allowed and the petitioner-Accused No.1 is granted bail subject to the following conditions:
i) The petitioner-Accused No.1 is directed to be released on bail on his executing personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for a like sum each, to the satisfaction of II Additional Judicial First Class Magistrate, Nizamabad.
ii) After release on bail, the petitioner-Accused No.1 shall appear before the concerned Station House Officer on everyday at 10.00 AM for a period of one month and thereafter as and when required for the purpose of investigation.
iii) The petitioner-Accused No.1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
