Heard both sides. With the consent of both parties the writ petition is disposed of at the admission stage. 2.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the rej ection order issued by the third respondent in C.No.61/ SPDO-North/ 2017, dated 05.07.2017, as illegal and arbitrary.

At the time when the matter is taken up for hearing, learned counsel for the petitioner would submit that nothing survives for adjudication in the present writ petition as no permission was given for meeting which was scheduled to be held on 07.07.2017. 4.

Learned Government Pleader for Home, on instructions, would submit that having regard to the situation prevailing in the area where the meeting was scheduled to be held and taking into consideration the manner in which crimes were registered against the persons who made an attempt to conduct the meeting, it may not be possible to grant permission immediately. However, according to her, if the situation which is existing as on today prevails, it may not be possible to grant permission.

It is to be noted that the situation which is prevailing today may not prevail in future. Each application made by the petitioner seeking permission for holding the meeting has to be dealt with independently taking into consideration the place, time, venue and other aspects.

Since the date on which the meeting was supposed to be held is over, learned counsel for the petitioner submits that his client is willing to make a fresh application fixing a date and venue for the next meeting, which may be directed to be considered. 7.

Having regard to the above, the writ petition is disposed of directing the petitioner to make a fresh application, if he intends to hold a meeting, in which event the same shall be dealt with, in accordance with law. No costs.

Consequently, miscellaneous petitions, if any pending, shall stand closed.
