THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.882 of 2010 ORDER:

This Criminal Revision Case is filed by the petitioner by invoking the provision under Section 397 of the Code of Criminal Procedure being aggrieved by order, dated 17.06.2009, passed in Criminal Revision Petition No.32 of 2006 by the IV Additional Sessions Judge, Karimnagar, whereby the learned Sessions Judge confirmed order, dated 13.04.2006, passed in C.F. No.807 of 2001 by the Additional Judicial Magistrate of First Class, Karimnagar.

Heard and perused the record.

A perusal of the record discloses that the petitioner has approached the Sessions Court by way of filing revision petition by invoking the provision under Section 397 Cr.P.C. Therefore, the present revision case amounts to second revision, which is not maintainable. Hence, the Criminal Revision Case is dismissed. However, it is left open to the petitioner to seek his remedy by way of filing criminal petition.
